In summary these representations set out that CBMDC is unjustified in not applying the 35% urban area uplift, which it is required to do as one of the 20 largest urban areas in the country.

Furthermore it has not adequately justified any deviation from the application of the Standard Methodology for the assessment of Local Housing Need (LHN). Accordingly, it is Persimmon’s position that the Local Plan should be based upon 2,300 dwellings per annum.

Representation Summary:

The site is lies in a sustainable location with easy access of a good range of local services and public transport services.

Green Belt releases are required in order to meet the future housing requirements of the District. The proposed removal of the site from the Green Belt and allocation for housing is justified and appropriate and that due to its contained nature surrounded by existing built form or defensible boundaries it would not prejudice the five purposes of the Green Belt as set out in the NPPF.

The site assessment demonstrates that the site has no significant technical constraints which would prevent its delivery for housing development.

The Initial Masterplan demonstrates the site could accommodate 140 dwellings whilst retaining and enhancing the PROW, providing new areas of public open space, retaining most of the existing vegetation and enhancing the ecology of the site through new tree planting.

The site is available and deliverable now and would make an important contribution towards meeting the housing requirements of the District.

The extent of Persimmon Homes control in relation to the northern part of the site varies slightly from the draft allocation and is detailed in the plan included at Annex 1. It is recommended that the allocation boundary be tweaked to reflect this.

Discussions are also taking place with the landowner of draft allocation site SH6/H Bankfield Farm, Nab Wood which abuts the western boundary of the site. Persimmon is willing to work collaboratively to deliver this site comprehensively alongside SH5/H.

Object to the green belt site assessment for SH5/H:

While we support the proposed allocation of the site for housing, we disagree with the Council’s assessment of the site against the 5 purposes (for detail see document).

We consider that the impact upon the green belt would be considerably less than that concluded by the Council.

Development of the site will not result in the unrestricted sprawl - it is considered to be infill development rather than extension to the existing settlement. Development of the site will not lead to a greater degree of merging of settlements than the existing situation. The site does not play an important role in safeguarding the countryside from encroachment.

The site is currently designated as Green Belt within the Replacement Unitary Development Plan (RUDP).

The Proposed Site Allocation Map identifies site SH5/H: Bingley Road, Nab Wood as a preferred housing allocation and of course is supported.

However, the Site Allocations Map also indicates that the site as being washed over by Green Belt. It is also displayed the same way in the separate ‘Local Area Strategy and Plan’ for Shipley as set out below paragraph 5.7.38 of the main part of the draft local plan.

This is clearly a cartographical error, as Policy SP5 (and associated accompanying text) of the draft plan relating to Green Belt is clear insofar as it identifies exceptional circumstances as required by paragraph 137 of the NPPF to remove land from the Green Belt, with part B of Policy SP5 listing the specific sites that should be released. This list includes site SH5/H.

Accordingly both the Site Allocation Map and the separate Local Area Strategy and Plan for Shipley should be amended, with it clearly depicting the site removed from the Green Belt consistent with Policy SP5 and to solely indicate its allocation for housing.

While we support the proposed allocation of the site for housing we disagree with some elements of the Council's assessment of the site against the 5 purposes (see document for detail).

Development of the site would effectively form infill development between the suburban development to the north and west and the retirement village immediately to the east.

The existing topography and tree cover to the south also naturally enclose the site to the south.

It is therefore considered that the site plays only a limited role in meeting the five Green Belt purposes, and it can be developed without harm to the wider Green Belt.

Draft Policy SP5 acknowledges that Green Belt releases are required in order to meet the future housing requirements of the District. It is considered that the proposed removal of the site from the Green Belt and allocation for housing is justified and appropriate and that this would not harm the role and overall purposes of the wider Green Belt.

The site assessment demonstrates that the site has no significant technical constraints which would prevent
its delivery for housing development.

The site could accommodate 130 dwellings whilst retaining and enhancing the PROW, providing new areas of public open space, retaining most of the existing vegetation and enhancing the ecology of the site through new tree planting. An indicative masterplan will be submitted at the next round of Local Plan consultation.

The site is available and deliverable now and would make an important contribution towards meeting the
housing requirements of the District.

In light of the above, the proposed allocation IL1/H Wheatley Grove is supported and should be taken forward in the Draft Local Plan.
