There are therefore significant constraints and legal challenges on these
sites. The principle driver for a number of these B SW appears to be fiscal
as these are alleged to be Publicly owned sites in the matter of 400 Acres
of Low Moor Land protected under parliamentary Act it should be noted that
land does not belong to the Council they are merely the Custodian of a
Benevolent Gift which technically must remain for the giving of recreation
to the poor of North Bierley .

Planning Bias Drivers re Density /Number
The New Homes Bonus Scheme provides cash for areas that allow new homes to be built in their area. Government funding has been set aside for local councils that welcome new housing development, which they can spend to benefit their local community.
Under the scheme the Government matches the council tax raised from new homes for the first six years through the New Homes Bonus. Councils and communities work together to decide how to spend the extra funding - whether council tax discounts for local residents, boosting frontline services like rubbish collection or providing local facilities like swimming pools and leisure centres. To continue with the Local Plan which has not yet been adopted on the basis that Citizens have been fully consulted for the reasons given is therefore flawed

This site is a school playing field and is on the citys asset register as being leased long term to the Christopher Wharton academy .It is open space and school land and is assessable by both school and the public the description therefore is misleading. As such the land remains open space and therefore statutory process would need to be followed .The council have failed to identify constraints with regard to this site.

Potential mine entry shaft / coal workings at NE corner of site.
• The majority of the site lies within the 200M buffer zone of overhead power line.
• The site lies within the outer tier consultation zone for BASF/Nufarm, Opportunity to include the site within master plan for adjoining site SW14/H. No such masterplan was ever registered on the Register of Master Plans under development processes in relation to the attached map circa 2005 and remains highly controversial. with substantive local objections relating to it and the infrastructure and access limitations included in HM Inspectorate report where little has changed.

Although I have no objection as the site is brownfield ,I have objections relating to the factual information regarding access to the site which is incorrect .Odsal road is not the existing access for the site and is quite a distance away .The site constraints relate to access the land to the north is a crude unadopted rd adjoining the main highway in proximity to a school .access to the south is via a busy A road on a steep hill with restricted width ..

This site formes an important Green Corridor and when taken in conjunction with SE40/E and SE42/E and when taken in conjunction with existing housing presents significant Environmental Impact to Odsal Woods a Deciduous semi ancient woodland (Odsal Wood) immediately north-west of site.
The infrastructure and Highway is limited by geographical constraints and it is unclear whether the site access will necessitate structural attention to crossing the Bowling Tunnel or through existing residential area with all of the impact considered in an EIA Screen Constraints and Opportunities
The site is a landfill location and a significant proportion of the site is within a landfill buffer . Significant Constraints are associated with landfill to ensure Environmental Regulations are complied with .
